Commission Regulation (EU) No. 691/2010 as amended by Commission Regulation (EU) No. 1216/2011 lays down a performance scheme for air navigation services and network functions. The Regulation establishes three Safety Key Performance Indicators (SKPIs) that States must report on. These are 'Effectiveness of Safety Management' and 'Just Culture', (both of which are measured annually through a questionnaire) and 'Application of the Risk Analysis Tool (RAT)' which, since 1 January 2012, is to be applied on a continuous basis to specified occurrences.

In order to both prevent and mitigate the consequences of airspace infringements, pilots
operating close to the peripheries of certain controlled airspace (but not requiring an Air Traffic Service) are strongly encouraged to monitor the relevant ATC frequency. Pilots monitoring the promulgated ATC frequency should select a local SSR conspicuity code and Mode C pressure-altitude mode (if available) as specified to indicate they are monitoring the frequency. Frequency Monitoring SSR Codes are being introduced for Aircraft operating in the vicinity of Leeds Bradford International Airport, East Midlands Airport and Farnborough Airport. Dated: May 2012

Further to IN-2011/078 and IN-2012/045, the Bilateral Safety Agreement took effect on 1 May 2011. The agreement requires the transfer of oversight of FAR 145 Repair Station Certificates held by Part 145 approved organisations from the Federal Aviation Administration to the National Aviation Authority in the State where the organisation is located. This transfer must take place within two years of the entry into force of the agreement. UK CAA is intending to begin the transfer process in April 2012 and to have all approvals transferred by October 2012.

The Civil Aviation Authority's Official Record Series 4 (Four) contains a General Exemption which permits holders of valid aeroplane licences issued by the CAA (other than National Private Pilot's Licences (NPPL(A)s) to exercise the privileges of those licences as if they are NPPL(A)s. This is in the circumstances where the licence holder does not hold a medical certificate appropriate to the licence, but does have a Medical Declaration appropriate to the NPPL(A).

IN-2012/031: Use of Unauthorised ATM Procedures The CAA has become aware that ad-hoc procedures may be being used, for example, during periods of low traffic such as those that can occur overnight. The CAA is concerned that the use of procedures other than those that are documented in unit instructions may present unacceptable risk to airspace users. IN-2011/092: ATCO Licensing and Medical Certification CAA Information Notice IN 2011/087 notified of the publication of Commission Regulation (EU) No 805/2011, effective on 30 August 2011, which lays down detailed rules for air traffic controllers' licences and training. This new Regulation repeals Directive 2006/23 (the 'ATCO Licensing Directive') but introduces no substantive changes from those provisions set-out previously in the Directive, which was implemented in the UK by Part 24 and Schedule 10 of the UK Air Navigation Order (ANO) 2009. Student and full ATCO licences and medical certificates issued in accordance with the Directive will remain valid; however, issue of new licences and medical certificates may only be done in accordance with Regulation 805/2011 by the competent authority nominated by the State for that purpose.

The UK is under an international obligation (EC Decision 2008/477/EC) to make available the 2.6 GHz band for terrestrial systems, such as mobile data communications. Ofcom are currently consulting on how to award this spectrum in 2012. The relevance of this issue to the aviation community is that S-band radars, operating in the 2.7 - 3.4 GHz band, could experience unwanted effects from legitimate transmissions in the adjacent 2.6 GHz band. This issue was highlighted in ATSIN 168, published in November 2009. In order to prevent such unwanted effects, it will be necessary for all S-band radars to be fitted with a filter and/or other modification as identified by manufacturers/Design Authorities (DA). It may also be necessary for a small number of radars operating at the lower end of the 2.7 - 3.4 GHz band to change frequency to one higher up the band.

In accordance with the original mandate and the subsequent developments, regulatory material has been prepared, extending the application of 8.33 kHz communications to the airspace below Flight Level 195. A Draft Implementing Rule has been developed in close consultation with Stakeholders, based on a Regulatory Approach and taking into account Stakeholder input on all aspects of the Air-Ground Voice Channel Spacing requirements.
