Article 39, in conjunction with Schedule 5, of the Air Navigation Order 2009 requires that aircraft flying IFR in the UKin Controlled Airspace, and/or flying above FL 245, carry ADF equipment in the aircraft. The increased application ofRNAV on ATS routes and terminal flight procedures and the allowance under European rules for commercial airtransportation are increasingly making the mandatory carriage of ADF redundant. This exemption describes the navigation equipment required in specified circumstances in lieu of ADF equipment.

The purpose of this exemption is to allow certain aircraft that hold a valid national Permit to Fly with a maximum take-off mass not exceeding 1500 kg to over-fly congested areas in contravention of a standard condition currently specified on all Permits to Fly. Flight over congested areas may only be carried out in accordance with the conditions stated on the exemption. The exemption will remain in force until such time as the CAA issues replacement documents.
